These Terms of Use govern your access to and use of crowdcastinginc.com, operated by Crowdcasting Inc., a California corporation ("Crowdcasting," "we," "us" or "our"). By using the Site, you agree to them. If you do not agree, do not use the Site.

The Site describes Crowdcasting's services and lets you apply to become a client or a partner. It is informational. Nothing on the Site creates a campaign, a partnership, an engagement or any obligation on either side. Campaigns exist only under a separate written agreement.
Nothing on this Site is an offer to sell, or a solicitation of an offer to buy, any security. Nothing on this Site is investment advice, a recommendation, or an offer of any investment opportunity. Any securities offering, if one is ever made, would be made only through separate documentation, in compliance with applicable securities laws, and would supersede anything stated here.
Marketing and promotional results cannot be guaranteed. Crowdcasting does not guarantee sales, revenue, profits, customer acquisition, leads, reach, engagement, rankings, reviews, investment performance, or any other specific outcome. Statements on the Site describing what campaigns are designed to do are descriptions of intent and method, not promises of results.
Information you submit through the Site must be accurate and must be yours to submit. Do not submit anything confidential to a third party, anything you are not authorized to disclose, or anything false. We may decline any application for any lawful reason, or for no reason.
You agree not to: use the Site unlawfully; submit false, misleading or fraudulent information; attempt to gain unauthorized access to any system; interfere with the Site's operation; scrape, harvest or bulk-collect content or data; introduce malicious code; or use the Site to send spam or unsolicited communications.
The Site and its contents — including text, design, graphics, logos, the Crowdcasting name and marks, and the underlying framework and terminology — are owned by Crowdcasting or its licensors and are protected by intellectual property laws. You may view and print pages for your own evaluation of our services. You may not copy, republish, sell, license or create derivative works from the Site without our written permission.
The Site may link to third-party websites. We do not control them and are not responsible for their content, practices or policies.
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT ANY INFORMATION ON IT IS ACCURATE, COMPLETE OR CURRENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CROWDCASTING AND ITS OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST REVENUE, LOST DATA OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, WHETHER BASED IN CONTRACT, TORT OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.
You agree to indemnify and hold harmless Crowdcasting and its officers, directors, employees and agents from any claims, damages, liabilities and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your submissions, or your breach of these Terms.
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction there.
We may revise these Terms at any time by posting an updated version. Your continued use of the Site after a revision means you accept it.
If any provision is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between you and Crowdcasting regarding the Site.
